Guardianship is a legal proceeding in the probate courts in which a qualified individual or institution is appointed to exercise the legal rights of an incapacitated person concerning their health and well-being. A guardian is an individual or institution such as a child, relative or bank trust department appointed by the probate court to care for an incapacitated person or for the ward's assets.
